Triple talaq pleas not maintainable: Muslim board responds to SC

The All-India Muslim Personal Law Board (AIMPLB) responded on Monday to questions the Supreme Court framed in petitions related to triple talaq. It reiterated that the petitions were not maintainable because the petitioners sought to enforce fundamental rights against private parties.

The SC, which has already indicated that a constitution bench would determine the contentious issue, is likely to take up the petitions on March 30.

AIMPLB submitted that the protection sought by the petitioners is intended to be available against the legislature and the executive, but not against private individuals.

In the present case the petitioners, the board said, were seeking judicial orders that are completely outside the scope of Article 32, which is invoked if there is violation of one’s fundamental right.
