‘No flagpole at spot’: TN Govt to HC on accident that grievously injured Rajeswari

The government of Tamil Nadu on Friday told the Madras High Court that there was no flagpole at the spot where a 30-year-old woman Rajeswari met with an accident, which led to her losing a leg. 

The Madras High Court was hearing a bunch petition filed against the Tamil Nadu government on illegal banners and installations in the state. On November 11, 30-year-old Rajeswari came under a lorry when she allegedly tried to avoid a flagpole with AIADMK flag from falling on her. The accident led to the amputation of her left leg and multiple fractures on her right leg. 

The state government submitted in court that there was no AIADMK flagpole at the spot where 30-year-old Rajeswari had met with an accident on November 11 and added that no permission is being given to anybody to erect a banner after the court’s earlier order banning the same. 

After Rajeswari’s accident, eye-witnesses had alleged that she was trying to avoid an AIADMK flagpole erected on the side of the road from falling on her and that the manoeuvre made her lose balance and fall in front of a lorry. However, the police and the political party as well have maintained that this was not the case and the police had then arrested the lorry driver on charges of rash driving. 

The high court bench consisting of Justice M Sathyanarayanan and Justice N Seshasayee was on Friday also hearing a contempt case regarding illegal banners and also a case filed by the 23-year-old Chennai techie Subhasri’s father demanding Rs one crore compensation for the loss of his child. 

Subhasri was on her way back from her work on September 12 when she came under the wheels of a tanker lorry. She had fallen on to the road after an AIADMK digital hoarding erected on the centre median on the Thuraipakkam-Pallavaram radial road fell on her, causing her to lose her balance. The banner was erected for the family event of a former councillor of AIADMK S Jayagopal and the event was also attended by the Deputy Chief Minister of Tamil Nadu O Panneerselvam. 

Recording the government’s statements, the judges questioned as to why the compensation cannot be recovered from the political parties whose banner fell on Subhasri and posted the next hearing for January 6, 2020.
