The Madras High Court today restrained the District Registrar of Puducherry from registering any sale deed relating to unapproved plots/layouts and flats constructed in violation of planning permission.

The First Bench comprising Chief Justice Sanjay Kishan Kaul and Justice M Sundar before which the PIL from “Elephant” G Rajendran, an advocate, in its order said “on hearing the counsel for the parties, we are of the view that the stand of the Puducherry authorities that no conversion has been permitted.”

“To avoid complications by registering such unauthorized layouts, flats constructed in violation of planning permission, this application needs to be ordered. Again District Registrar is restrained from any registration of unapproved plots.”

The Government informed the bench that no conversion of agriculture land has been granted in the recent past nor proposed to be approved, till such time as relevant rules comes into force which was also recorded by the bench.

According to the PIL, realtors in Puducherry were converting the agricultural lands into plots.
